Legal and Ethical Best Practices Regarding Manifestation Determinations, in addition, a Legal Q&A From Participants - brought to you by SCCASP, NECASP, and SBASP

This course will fulfill 3 CEU units for law and ethics requirement by BBS for LEPs. Ms. Kaitlyn Tucker will review the requirements for a legally defensible manifestation determination review, using case law and real-life examples to illustrate best practices and assist with navigating tricky situations. The session will end with "Stump the Chump," so bring your best hypotheticals! This workshop will be recorded.

Kaitlyn Tucker is an Associate in Lozano Smith's Sacramento office. Ms. Tucker primarily represents public school district clients on issues related to special education and student matters.

Ms. Tucker represents local educational agencies in all aspects of due process proceedings with the Office of Administrative Hearings, including resolution sessions, mediations, settlement negotiations, and hearings. She regularly assists clients with responding to complaints filed with the California Department of Education and the Office of Civil Rights. Ms. Tucker also represents and advises districts through the IEP and 504 process, including attending IEP meetings, reviewing assessments, drafting prior written notices, and ensuring compliance.

Ms. Tucker frequently provides guidance and represents school districts with student discipline-related matters, including expulsion hearings. She also assists school districts with proactive measures to avoid disputes, including policy and procedure reviews and assisting with alternative dispute resolution sessions. Her professional experience includes working with the California College Guidance Initiative, the Office of Fair Housing and Equity, and the Office of Senate Counsel.


This course meets the qualifications for 3 hours of continuing education credit for LEPs, LMFTs, LPCCs and LCSWs as required by the California Board of Behavioral Sciences. This course also qualifies for 3 hours of continuing professional development for Nationally Certified School Psychologists, under provider number 1025. CASP maintains responsibility for the program and its content.
